L1A申请遇到补件或被拒怎么办？
songmenglaw / 0 Comments /最近常常有L1申请人来询问，是否现在的L1变得更难申请了？很多申请人感觉到，现在L1的补件变多了，有些甚至被拒绝，又或者L1通过后在海外领馆申不到签证，抑或后期移民局实地调查后，发出撤销通知。
孟小洁律师认为，这种感觉是基本准确的。在2016年移民局向国会提交的报告中就提到，加州处理中心的L1A补件率，达到了20年来之最高的55%，即超过半数的案件会被要求补充材料。就L1A而言，佛蒙特（Vermont）处理中心的补件率相对低一些，但是也在29%。此外，其实来自不同国家的申请补件率和拒绝率也有差异。

USCIS to Resume H-1B Premium Processing for Certain Cap-Exempt Petitions
songmenglaw / 0 Comments /The U.S. Citizenship and Immigration Services (USCIS) announced on July 24th, 2017, that it will resume premium processing for certain cap-exempt H-1B petitions effective immediately. The H-1B visa has an annual cap of 65,000 visas each fiscal year. Additionally, there is an annual “master’s cap” of 20,000 petitions filed for beneficiaries with a U.S. master’s degree or higher.

当移民局来敲门：L1 申请人如何应对检查
songmenglaw / 0 Comments /近几年，来自中国大陆申请L1跨国经理人的人数显著上升。由于申请数目的整体持续攀升，以及一直以来对于L1加强监管的呼声，政府对于L1的审查明显收紧。不仅如此，L1的实地抽查比例也在上升。在之前川普政府公布的草案中，也有提到过政府加强L1实地抽查的论调，具体请参见之前的文章《川普攻势一浪高过一浪，华人移民路在何方？ 》。
L1实地抽查的政策一直都有。每个L1申请人都要向政府交500美金的打假费用，就是为了资助政府组成相应的打假小组，核实L1申请的真实性。
目前，移民局打假小分队主要针对的几种签证类型是：1）宗教类工作签，每一份申请都会面临实地考察，可能在批准前也可能在批准后；2）L1和H1B，批准后会有一定比例的抽查。
