H1B RFE六大原因之难度系数大盘点
songmenglaw / 0 Comments /5月底的时候，今年加急处理（premium processing）的H1B案件基本都已经得到了初步的处理结果通知。从6月1日起，宋和孟律师事务所（Song & Meng, PC）开始收到非加急案件的初步处理通知。目前，还有不少非加急的H1B案件仍然在审理中。宋和孟律师事务所预计今年大部分的非加急H1B案件应该会在本月内得到初步的审理结果。
什么是“初步审理”的结果呢？有两种可能。一种就是皆大欢喜的审批通过。这不仅是初步的结果，也是最终的结果。收到批准通知的申请人，可以放心地安排自己后续的生活和工作了。
如果没有立即得到批准，那么很有可能得到的是RFE (request for evidence)，也就是要求补充材料的通知。为什么要补充材料呢？移民局发出补件通知的理由多种多样，可能是由于要求进一步的材料证明职位的专业性，也有可能是公司的信息和移民局数据库里的不一致要进一步核实。一般RFE会给将近90天的准备期。

Fiscal Year 2017 H-1B Cap Premium Processing to Begin May 12

DMV Benefits for H/L Receiving an Automatic 240-Day Extension of Work Authorization
songmenglaw / 0 Comments /On February 25, 2016, the Citizenship and Immigration Services Ombudsman’s Office hosted a public teleconference on issues related to Department of Motor Vehicles (DMV) benefits for certain nonimmigrant workers, including H and L nonimmigrants. Individuals whose employers timely file for extension of nonimmigrant status receive an automatic 240-day extension of work authorization while the petition remains unadjudicated. The discussion focused on the impact of the REAL ID Act on how states DMVs treat individuals subject to the 240-day rule for non-immigrant workers.
